The Supreme Court just upheld Obamacare … as a TAX:

A divided Supreme Court largely upheld the Obama administration’s health-care law, saying the law’s penalty for those who ignore a mandate to carry health insurance counted as a tax and was justified by Congress’s constitutional taxing power.

    It is a scientific fact that these brutes (the American populace) must be governed by a sovereign who treats them based on the Laws of Nature: like animals – the herd is incapable of thinking or rationalizing what is in their best interests.

    According to English philosopher Thomas Hobbes (1588 – 1679), the sovereign has several important functions: he decides all issues of right and wrong, importantly, without any external reference to religion or political argument – this is the essence of sovereignty. There is no standard above sovereign’s decision, no divine law, no human rights, no moral rights that could annul his decision. This should be so in order that all disagreements among (groups of) subjects be cut short. He can decide anything at all, rules of arithmetic, meaning of words, etc. The sovereign also punishes, including with death, those who disobey in order to make agreements possible and enforceable (in contrast to the situation in the state of nature).

        You would be surprised to know people of Anglosaxon/English extraction are only 8 percent of the USA and only Anglosaxon tend to be impressed with the so called intellectualism of Anglosaxons.     Lack of access to health care is the seventh leading cause of death in the country, and that says something. It doesn’t get much more elite than being part of a club other people are literally dying to get into. So what incentive would there be if everyone were guaranteed equal health care, regardless of income, age, or employment status?     GW, you failed to state how many of those will actually be paying such a “tax” 6% of mega millionaires who failed to provide such benefits for their workers. Example: Gas Station attendants, waitresses, security officers and other laborers. Taking reasonable care to protect the health of your employees is not only the right thing to do, it part of the cost of doing business here in America. The working and middle class consumer made them rich. There’s nothing wrong with that. They just need to stop biting the hand that truly feeds them. We have Medicare and its efficient. Government actually CAN do a few things right. If its so bad here, go someplace else and maybe you can appreciate the progress. Then you may actually want to read all of the healthcare plan before you diss it. Be sure who discover who insisted that it HAD to be a mandate when it really didn’t. A mandatory policy or you get fined. Excuse me? Drop your car insurance and see what happens. You can’t, because it’s illegal not to have it. While you are at, stop paying your homeowners insurance-just don’t live next to me.

    When that letter comes telling you when and how you must sign up for obamacare, wouldn’t it be fun to simply ignore it? If enough people did that, the State would be up to its ass with cases. Same with income tax, but that would be harder to rally people around.

    No, the penalty is not a “tax” – it is a fine for disobeying the Order to shell out for a private, for-proffit financial product – whose cost is not a tax, either, because TAX GOES TO THE GOVERNMENT – not straight into INSURANCE RACKET wallets!

    And no, most Americans – already with health care “insurance” – won’t notice any difference at all: they’ll simply continue to die, by the tens of thousands – and be bankrupted, by the hundreds of thousands – each year by HealthCare COSTS NOT COVERED under their wonderful “insurance”.

    If the personal mandate and penalty for not obeying it WERE a tax, the high court could not have heard a lawsuit on that issue. Reason? No tax can be sued over until it takes effect, and someone has been subjected to paying it. Before that, it’s a moot question.

    That was the reason one of the lower courts threw out the lawsuit on that matter. They said it was a tax, and that the 19th century law the Anti-Injunction Act forbade anyone suing on that until it took effect.

    The Supreme Court knows this bit of law, and found it was NOT a tax, to even begin addressing the lawsuits’ appeals at all. Otherwise, they’d have tossed that part of the lawsuits and not considered that question whatsoever.

    The only one saying it was ‘like’ a tax was Roberts. The liberal four judges wanted to accept it under the Commerce Clause power, but went along with Roberts’ strained reasoning that it was kinda like a tax, so the taxation power justified it as Constitutional. The four justices in dissent did not think it was a tax (again, or else they’d have thrown out the suit pertaining to it under the Anti-Injunction Act, which remains binding law).

    So, Roberts himself held it was NOT a tax (like all the other justices), but ENOUGH LIKE A TAX to pass Constitutional muster. Semantics and legalistic formulations which do not make it so.

    As you must ask an attorney what language in a contract means, the cloistered world of the SCOTUS is not particularly clear as to what they talk about means. It requires a translator.

One of them, Elena Kagan, an Obama appointee, has ties with Goldman Sachs Israel lobby groups such as Brookings Institute and Washington Institute for Near East Policy (WINEP), an AIPAC off-shoot. Kagan was quoted as saying in February 2010: “Hizbullah builds bombs. Hizbullah also builds homes. What Congress decided was when you help Hizbullah build homes, you’re also helping Hizbullah build bombs. That’s the entire theory behind the statue”.
